Terms and Conditions

The Terms and Conditions set out below (“Terms”) apply to the delivery of neurodevelopmental screening and assessment services for Autism and ADHD conditions (“Services”) by the Autism ADHD Centre (AAC) (“we”, “us”).

When you register with us as a patient or potential patient, or engage with us via our website at www.autismadhdcentre.com (“Website”), our social media platforms or digital applications, or via email or other methods of communication, you accept these Terms, along with our privacy policy and such other policies as are displayed on our Website.

Please ensure you carefully read and understand these Terms before engaging or contacting us, or accessing or using our Services. If there is anything within these Terms which you do not understand or agree with then please contact us before proceeding to use or access our Services.

URGENT OR EMERGENCY CARE: PLEASE NOTE

Our Services are offered on an outpatient, scheduled appointment basis only. We do not provide Services, care or support to individuals who are in crisis, or who require urgent assistance.

If you, or someone you have caring responsibility for, requires emergency assistance then you should contact your local NHS crisis team, attend your nearest Accident & Emergency hospital, or contact the emergency Services using 999 or 111.

1. About our Services

IMPORTANT: Your decision to access our Services does not guarantee that you will receive a positive diagnosis.

1.1. We provide screening and assessment services relating to the potential diagnosis of Autism and/or ADHD conditions only. We do not offer prescription services or provide post diagnosis care, treatment plans, or any other related support and you are recommended to inform your General Practitioner (GP) or other health care practitioner about your use of our Services and to seek relevant help, support and advice from them as is necessary.

1.2. We deliver our Services using reasonable skill and care, consistent with best practice and standards according to national guidelines for England and in compliance with all relevant regulations, standards, codes of conduct and ethical practice that apply or are relevant to provision of the Services. Our assessments are undertaken by experienced, qualified clinicians who are certified and insured to provide those Services and do so in compliance with NICE guidelines.

1.3. During your use of our Services, you may be asked to share personal information with us. Any information you share with us will be dealt with in accordance with the privacy section of these Terms (below) and our privacy policy (available on our Website).

1.4. If at any time during delivery of our Services we consider, in our professional clinical opinion, that other treatment or support may be required, then we may provide you with details of other services that we offer, or with details of alternative therapists, practitioners or medical professionals.

2. Your responsibilities when using our Services

2.1. You agree:

2.1.1. that you are over 18 and are legally capable of consenting to these Terms;

2.1.2. to provide us with a true, accurate and up to date physical and mental health history and to notify us if any of that information changes;

2.1.3. to provide any other information which may be relevant to our delivery of the Services;

2.1.4. to provide us with identification documentation as required;

2.1.5. to inform us immediately if any of your details or circumstances change.

2.2. You accept and agree that as part of your engagement, use, or access to our Services that:

2.2.1. we will use, review and process your personal information, including medical and health related information;

2.2.2. we may share your personal information, including medical and health related information with our employees, contractors, clinicians and other third-party service providers that support our delivery of the Services;

2.2.3. we may share your personal information with GP’s, the NHS and other professionals as required.

2.3. At all times you will remain fully responsible for your own health and well-being. Your decision to access the Services should not be seen as an alternative or replacement to any existing medical treatment that you are undergoing or may require. Should you have any concerns concerning your health, diet, medication or any medical conditions, then you agree to seek the advice of your own GP or other medical practitioner.

2.4. If you are currently receiving medical or other professional support concerning your physical or mental health then you agree to inform your medical practitioner of your intention to use our Services and to provide us with any information which may be relevant to the Services or which may affect our delivery of the Services.

2.5. During your use of the Services, you may be exposed to information or situations that could trigger unresolved or other emotional responses. By accessing and using our Services, you are confirming that you are mentally well enough to do so and that you understand that you are personally responsible for managing your own emotional state. You agree not to hold us liable for any emotional distress experienced as a result of your use, access or engagement with the Services and we reserve the right to suspend and/or terminate your access to the Services where we have concerns as to your suitability to safely use them and any refunds in these circumstances will be at our discretion having regard to the particular circumstances and the level of Service (if any) already delivered to you.

3. The Assessment Process

3.1. Once you have completed your patient registration and screening, we will contact you to confirm if you have been accepted for assessment. If you have been accepted for assessment then you will be able to book an appointment for your assessment using our online booking system.

3.2. Assessment appointments take place in person at the AAC. Prior to your assessment date you will be asked to provide further information which may include providing details of a contact who knew you well during your developmental phases during childhood and teen years and would be willing to share information with us. This may be a relative, friend or your GP. If you are unable to nominate anyone, please let us know and we will review your case to determine whether we can proceed with your assessment without a nominated person.

3.3. Following your assessment appointment your case will be reviewed by our Multi-Disciplinary Team (MDT) before your assessment report is produced.

3.4. Whilst all assessments are conducted by one of our experienced team of clinicians who are qualified consultant psychiatrists or psychologists and undertake assessments in compliance with NICE guidelines and relevant regulations, standards and codes of conduct, you accept and understand that different clinicians may provide different clinical decisions or opinions on the same condition or symptoms and the difference in that decision or opinion does not indicate that the decision or opinion is incorrect or that any associated Service is defective.

3.5. You accept that any diagnosis, decision or opinion is based upon the information and medical history you provide and the particular clinician’s professional judgment. You accept that we are unable to guarantee you any particular result or outcome from using or engaging with our Services.

3.6. You agree that when we provide you with your assessment report, any letters, or any other documentation created by us or our patient system, that you will not amend, alter or tamper with them in any way.

4. Appointments

4.1. You agree not to attend any appointment under the influence of recreational drugs or alcohol and we reserve the right to cancel or reschedule an appointment or to terminate any agreement between us, without refund, where you fail to adhere. Details of any prescribed medications should be provided to us prior to your appointment.

4.2. Appointments are managed via our online appointment system. You can cancel and reschedule up to 48 hours before the scheduled appointment time using the online system. Appointments changed or cancelled with less than 48 hours’ notice will be forfeited and no refund will apply.

4.3. If you are running late, please contact us by email to info@autismadhdcentre.com. If we are waiting for you to attend your appointment for more than 15 minutes from the scheduled start time, we reserve the right to treat you as a no show and you shall forfeit your right to that appointment and no refund will apply.

4.4. We operate a zero-tolerance policy towards disrespectful, aggressive or abusive behaviour. This includes any personal, abusive or threatening comments, language or physical contact or gestures. When accessing our Services and attending your appointment you agree to conduct yourself in a responsible manner at all times. We reserve the right to terminate your appointment and cancel any agreement between us, without refund, where we consider you are in breach of this clause and should we deem it necessary, to contact the police and/or seek legal intervention.

4.5. You agree to be responsible for your belongings and any personal effects at all times when attending your appointment.

4.6. Should a situation arise where we need to reschedule your appointment then we will make all reasonable attempts to provide you with as much notice as possible and to reschedule to a mutually convenient time.

5. Emergency contact

5.1. All appointments should be made or altered using our online appointment system. Should you require urgent attention or assistance then we recommend that you contact your local NHS crisis team, attend your nearest Accident & Emergency hospital, or contact the emergency Services using 999 or 111.

6. Your privacy and personal information

6.1. The protection of your personal information is very important to us and that is why when you disclose or share any personal information with us, we agree to look after it and only use it as set out below and in accordance with our privacy policy, available on our Website. When you register as a patient you will be asked to confirm that you understand and accept the terms of our privacy policy.

6.2. Any personal information you provide to us will be maintained, stored, accessed and processed in accordance with recognised data protection laws and legislation including the UK GDPR and the Data Protection Act 2018. We shall only process your personal information to the extent reasonably required to enable proper delivery of the Services and shall retain it only for as long as reasonably necessary to allow completion and delivery of the Services and to comply with any legal or regulatory requirements. 6.3. Our clinicians undertake regular clinical supervision and engage in multi-disciplinary team (MDT) meetings. All discussions that take place during supervision or MDT meetings are confidential.

6.4. You accept that in connection with our delivery of the Services that we may be required to share information with your GP, the NHS and/or other medical professionals or specialists and you provide your consent to such disclosure.

6.5. Any of our obligations arising under this clause shall not apply where it is necessary for us to disclose in connection with legal proceedings, prospective legal proceedings (whether or not in relation to these Terms), to allow us to obtain legal advice, where we have been directed to do so by a court or other body of equivalent jurisdiction or where it is necessary because we reasonably believe you are at risk of danger to yourself or others.

Our third-party suppliers

6.6. As part of the assessment process, you may be required to undertake screening and diagnostic tests which require you to provide your personal information. You accept that any information that you share with any third-party suppliers will be at your own risk and it shall be your responsibility to review each supplier’s privacy and security policies prior to you sharing any information with them.

6.7. Our patient information system is provided by Carebit and when you register as a patient you will be asked to set up a personal account with Carebit. Carebit use SSL encrypted connections and data is stored in an encrypted database. 6.8. You will be required to accept Carebit’s terms and conditions, including the terms of their privacy policy, when you set up your account with them. Whilst we understand that Carebit take necessary and reasonable precautions to look after your personal data, you accept and agree that there are always risks associated with the transmission of information via the internet and that any information sent to Carebit will be at your own risk.

6.9. If you proceed with an assessment for ADHD, you may be asked to complete diagnostic tests via QBcheck and Multi-Health Systems Inc (“MHS”).

QBcheck

6.10. Qbcheck measures the three core signs of ADHD and is used by us to support our assessment process and provide essential diagnostic information. You will be required to set up a patient ID with Qbtech and we will share information with Qbtech such as your date of birth, height, weight, gender. 6.11. Any personal information you provide to Qbcheck will be held securely for a period of 5 years. After expiry of that 5-year period your data will be anonymised and a randomised ID assigned which will prevent the data from being identified or connected to you but still allow use of the test data by Qbtech to support the development of diagnosis and treatment technology.

MHS

6.12. MHS provide tools for the assessment of ADHD. You will be required to set up an account. MHS is committed to confidentiality and safeguarding of all personal information that is collected. MHS conforms to ISO/IEC 27001:2013 and the GDPR and uses security and encryption protocols to protect its websites. 6.13. We may also utilise artificial intelligence technology (“AI”) to support and assist our delivery of Services. Where we do make use of AI, this will be to enhance our service delivery and not to replace any professional input. All outputs will be reviewed to ensure accuracy and any information or data processed will be handled in compliance with the relevant data protection legislation and our privacy policy, as set out above.

7. Payment for our Services

7.1. Our Service charges are displayed on our Website. Payment for all Services must be made in advance using our online payment system.

7.2. All payments are non-refundable unless the following circumstances apply:

7.2.1. you cancel your purchase within the consumer cooling off period, as further described below; or

7.2.2. we are unable to deliver the Services to you (as set out in Clause 10.2) in which case you shall be entitled to a refund for any Services which you have paid for but have not yet received.

7.3. We reserve the right to change our fees and charges at any time. Any pre-booked appointments will not be affected by any changes.

8. Your rights as a consumer

8.1. When you purchase our Services as a consumer, you will be entitled to a 14-day cancellation period which begins from the date of your purchase.

8.2. If you book an appointment for a date which is less than 14 days from the date of your purchase then you acknowledge you will waive your statutory right to cancel.

8.3. If you wish to cancel within the 14-day cancellation period, then you must let us know by sending an email to info@autismadhdcentre.com. Upon receipt of your notice of cancellation we shall provide you with a full refund less our administration fee (£65.00) and any bank charges applicable to the refund process.

9. What to do if you are unhappy with our Service

9.1. It is really important to us that you are comfortable and entirely happy with the Services. If you do have any concerns then please let us know by email to info@autismadhdcentre.com.

9.2. Where we receive notice of any concern then we will confirm receipt by email and follow our internal complaints handling procedure to investigate before providing you with a written response. Please allow us a reasonable time to deal with your complaint or concern.

9.3. We reserve the right to vary or re-perform the Services where we consider a concern is justified and in such cases these Terms will apply to any re-performed service.

10. Cancellation and Termination

10.1. Should you wish to cancel your appointment then you can do so via the online appointment system or by emailing us. Please remember that where an appointment is cancelled with less than 48 hours’ notice that you will remain liable for full payment of the Service charge, despite any notice of cancellation.

10.2. We may end our agreement with you where we are unable to continue providing you with the Services for any reason. In such circumstances we will provide you with notice in writing along with a refund in accordance with clause 7.2 above.

10.3. We reserve the right to limit or suspend your access to the Services where we reasonably consider that you have acted or behaved dishonestly, fraudulently, or in a way which may have a detrimental effect on our business or reputation, where you have breached the terms set out in clauses 2.1, 2.2, 3.6, 4.1 or 4.4, where you are failing to positively engage with the Services, or where you are acting in a way which is abusive or intended to cause offence to us or any of our employees, agents or contractors.

10.4. Where we limit or suspend delivery of the Services pursuant to the clause above, then following such action we shall arrange a meeting with you to discuss the matter and to determine whether our agreement will be terminated. Where we decide to terminate our agreement, any decision to provide you with a refund will be entirely at our discretion and will be based upon your actions and the level of Service already delivered to you.

11. Liability

11.1. We do not accept liability for any loss or damage not caused by our breach, or for any losses (including business losses), or any indirect or consequential damages or costs that were not foreseeable, whether caused by us, our agents, contractors, third party service providers, employees or otherwise.

11.2. We shall not be liable to you for any delay or failure to deliver the Services where we are prevented due to an event or another reason beyond our reasonable control. If such circumstances arise, we will contact you as soon as we are able to confirm what we are doing to mitigate the impact and when we expect to recommence delivery of the Services.

11.3. You accept that different medical practitioners or clinicians may provide different clinical decisions or opinions on the same condition or symptoms and the difference in decision or opinion does not indicate that the decision or opinion is incorrect or that any associated Service is defective. We make no representation or warranty as to the result of any clinical decision, the consequences that may follow any result or clinical decision, or the content of any assessment report or documentation following an assessment. Save as expressly set out within these Terms, all warranties, conditions or other terms, implied by statute or common law, are excluded to the fullest extent permitted by law.

11.4. You accept that any assessment, diagnosis, decision or opinion is based upon the information and medical history you provide and the particular clinician’s professional judgment. You agree and understand that access to or use of our Services does not guarantee any particular result or outcome.

11.5. Any information or content provided on our Website is intended for information purposes only and should not be relied upon as medical advice or as information personal to you and we make no warranties or representations as to the accuracy of information on our Website.

11.6. We use third-party systems to manage patient information and support our assessment processes and whilst we take all reasonable precautions to protect patient information, we do not accept liability for any corruption, compromise, data loss, breach, misuse or any other information related issues or errors which are outside of our control.

11.7. Subject to clause 11.8, our entire liability to you, to the extent permitted by law, shall be limited to the fees paid by you to us in the 12 months prior to the time any loss arose.

11.8. Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence or for any fraudulent misrepresentation.

11.9. Nothing in these Terms seeks to excuse or limit your legal rights as a consumer. For further information concerning your legal rights please contact your local Citizens Advice Bureau.

12. Who we are and how to contact us

12.1. The Services shall be delivered by the Autism ADHD Centre (AAC) which is a trading name of Dr Sandeep Mind Body Medicine Limited. Our business address is 110 Elliott Court Coventry Business Park, Herald Avenue, Coventry, CV5 6UB.

12.2. If we need to contact you, we will use the telephone number or email address you provide to us when you register. If you change your contact details it will be your responsibility to notify us so that we can update our records.

12.3. To ensure we maintain a professional working relationship we will not engage with you on any social media platforms or at any public events or engagements. Should you see us in public then please do not be offended if we do not engage in clinical or medical related conversations or discussions.

12.4. Any reference in these Terms to a notice shall mean notice in writing sent by email to the email address above. All emails will be taken as delivered 48 hours from valid transmission.

13. General

13.1. We shall have the right to assign, mortgage, charge or sub-license or otherwise delegate any of our rights arising out of, or in connection with this agreement. You accept that the agreement is personal to you and any rights or benefits may not be transferred without our consent in writing.

13.2. If either of us fail or delay taking action under these Terms that shall not affect or prevent our rights to take action at a later date.

13.3. If any part of these Terms is deemed invalid, or unenforceable for any reason then that part shall be struck out and the remaining part (s) shall remain valid and enforceable.

13.4. These Terms represent the entire agreement between us to the exclusion of any other terms, discussions or representations.

13.5. No one other than a party to this agreement shall have any rights under these Terms.

13.6. Where we deem it necessary to vary or modify these Terms (other than payment terms) or the terms of our privacy policy then, if you are a current patient, we shall notify you of any changes by email and your continued use of the Services will be deemed as your acceptance of any changes. Updated versions of any amended documents will also be displayed on our Website and, where you are not a current patient, your continued access of our Website, or engagement with any Services (as applicable) will constitute your acceptance of any changes.

14. Applicable Law

14.1. These Terms and any dispute or claim arising out of them (including non-contractual disputes of claims) shall be governed by the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim.
